Affiliate Program- Terms and Conditions
1. Introduction
Welcome to the Dandylion Affiliate Marketing Program. This program is designed to reward our valued affiliates for referring new customers to our products. By participating in this program, you agree to comply with these Terms and Conditions. Please read them carefully.
2. Eligibility
To be eligible for participation in the Dandylion Affiliate Program, you must be at least 18 years of age and possess a valid method for receiving commission payments (e.g., PayPal, direct deposit).
Dandylion reserves the right to approve or reject any affiliate application at its sole discretion, without obligation to provide a reason.
3. Program Participation
Upon approval, affiliates will receive a unique referral code and/or tracking link to promote Dandylion products.
Commissions are earned on Qualifying Sales, defined as purchases made by third-party customers using the affiliate’s tracking link or code, excluding the affiliate’s own purchases or purchases returned within 30 days. Dandylion reserves the right to define exclusions at its discretion.
Affiliates must ensure all promotional activities comply with applicable laws, regulations, and advertising standards in their respective jurisdictions.
Affiliates may not engage in any form of misrepresentation, unauthorized brand use, or conduct likely to mislead consumers.
4. Commissions and Payments
Commissions are paid monthly via Tremendous, where affiliates can choose from various payout options (e.g., PayPal, Venmo, bank transfer, gift cards).
A 30-day cookie window applies. This means commissions are credited if a referred customer completes a qualifying purchase within 30 days of clicking the affiliate’s link.
Commission rates are determined by Dandylion and are subject to change with at least 14 days' written notice to affiliates.
Commissions are payable only on collected revenue from completed sales. Orders that are returned, refunded, cancelled, or found to be fraudulent will not be eligible.
All commissions are subject to review and may be withheld during fraud investigations or compliance checks.
Dandylion may deny or reverse commissions earned through fraudulent, illegal, misleading, or overly aggressive marketing methods.
Dandylion reserves the right to delay or withhold commission payments if breach of these Terms is suspected or under investigation.
Tax Responsibility: Affiliates are solely responsible for complying with any tax, duty, or reporting obligations resulting from commissions received through this program. While Dandylion does not provide tax advice, it is important to note the following:
- In accordance with IRS regulations, recipients who receive $600 USD or more in rewards in a calendar year through the same email address may be required to submit a W-9 form when redeeming rewards.
- Tremendous, our payout provider, will collect the necessary information and issue IRS Form 1099 for eligible U.S.-based recipients.
- Tremendous handles tax reporting on Dandylion's behalf for recipients who meet the IRS reporting threshold.

5. Coupon and Deal Sites
Posting referral codes or links on coupon aggregator websites (e.g., Honey, CouponBird) is strictly prohibited.
Any affiliate found to have knowingly or negligently allowed code sharing on such platforms will be terminated immediately and forfeit pending commissions.
Affiliates are encouraged to report unauthorized use of their codes to Dandylion promptly.
6. Intellectual Property
Affiliates may use Dandylion-provided promotional materials including logos, graphics, and product imagery, only as provided and without modification, unless prior written approval is granted.
All use of brand assets must be consistent with Dandylion's brand guidelines and should not mislead or create confusion about the affiliation.
7. Data Privacy
Dandylion complies with all applicable privacy laws, including the Personal Information Protection and Electronic Documents Act (PIPEDA).
Affiliates agree that any personal data collected or processed in the course of this program will be handled in accordance with Dandylion’s Privacy Policy and applicable legislation.
Affiliates must not collect customer personal data through Dandylion links or mimic Dandylion’s branding to collect unauthorized data.
8. Indemnification
You agree to indemnify and hold harmless Dandylion, its directors, officers, employees, agents, and affiliates from any claims, damages, liabilities, losses, costs, or expenses (including legal fees) arising out of:

your breach of these Terms and Conditions,

any misrepresentation or misconduct in your promotional activity,

your violation of any applicable law or regulation.
9. Termination
Either party may terminate the affiliate relationship at any time by providing written notice (email suffices).
Upon termination, the affiliate must immediately cease use of all Dandylion branding, marketing assets, and disable use of referral links or codes.
Commissions accrued up to the date of termination will be paid out in the normal payment cycle, except in cases of fraud or breach, where they may be withheld.
Survival: Sections 7 (Data Privacy), 8 (Indemnification), 10 (Limitation of Liability), and 12 (Governing Law and Jurisdiction) shall survive termination of this Agreement.
10. Limitation of Liability
To the maximum extent permitted by law, Dandylion shall not be liable for any indirect, special, incidental, or consequential damages, or for any loss of revenue, profits, or data, arising from or relating to participation in this Affiliate Program—even if we were advised of the possibility of such damages.
11. Amendments
Dandylion reserves the right to update or modify these Terms and Conditions at any time. Affiliates will be notified of material changes at least 14 days in advance. Continued participation following any changes constitutes agreement to the revised terms.
12. Governing Law and Jurisdiction
These Terms and Conditions shall be governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein. Any disputes arising under or in connection with this agreement shall be subject to the exclusive jurisdiction of the courts of Ontario.
13. No Partnership or Employment
Participation in the Affiliate Program does not create any employment, agency, joint venture, or partnership relationship between the affiliate and Dandylion. Affiliates are independent contractors and act solely on their own behalf.
14. Agreement
By applying to and participating in the Dandylion Affiliate Marketing Program, you acknowledge that you have read, understood, and agreed to be bound by these Terms and Conditions.
